Over the coming days, requests for interim measures will be sent to the European Court of Human Rights regarding the persons captured and considered missing as a result of the military operations unleashed by Azerbaijan on November 16. Human rights lawyer Siranush Sahakyan stated this in a conversation with "Armenpress".
“We get information from the families of both the missing and captured persons and we investigatw the cases. And naturally, requests for interim measures will be sent to the ECHR, there are processes in this regard. We will also take into account the ongoing interstate complaint to avoid repetition,” said Sahakyan.
According to her, the primary issue is the protection of the physical integrity and life of those individuals. The European Court does not apply interim measures in the form of release.
However, Sahakyan mentioned the ongoing processes at the UN International Court of Justice. Armenia has submitted a request to apply provisional measures against Azerbaijan in the UN Court. With this, among other demands, Armenia insists on the immediate return of Armenian prisoners of war. “We hope that within a few weeks we will have a legal decision on this issue," said Sahakyan.
After the November 16 Azerbaijani provocations, around 10 families of missing and captured persons are in contact with human rights lawyers.
“Filings are under preparation. We will present them to the ECHR in the coming days, tomorrow or the next day at the latest,” said Sahakyan.
Human rights lawyers are currently working intensively. There are videos confirming cases of captivity of missing people. “The circumstances of the disappearance tend to favor captivity,” she said.
Siranush Sahakyan and Artak Zeynalyan are dealing with this issue, and since there is an interstate complaint, Yeghishe Kirakosyan, the RA representative at the ECHR, is also involved.
On November 16, in the afternoon, the armed forces of Azerbaijan once again criminally violated the territorial integrity and sovereignty of the Republic of Armenia by attacking the Armenian positions located in the direction of the eastern border zone using artillery, armored vehicles and different caliber firearms.
As a result of the military operations of November 16, the enemy suffered up to 70 casualties and wounded servicemen, as well as significant losses of military equipment, in particular 4 armored personnel carriers, 1 Sandcat armored car, 5 vehicles (Kamaz, Ural, UAZ).
The Armenian side has 13 captured servicemen. Contact was lost with another 24 servicemen during military operations and their fate is currently unknown. Two military positions came under the control of the enemy. The identity of the two dead servicemen is known.
