The head of the "International and Comparative Law Center" Siranush Sahakyan and co-founder of "Path of Law" Ruben Melikyan represented Judge Davit Grigoryan’s interests against Liparit Melikjanyan, a member of the Supreme Judicial Council, in the Yerevan court.
In September 2019, the judge of the Yerevan Court of General Jurisdiction (authorities are suspended, ed.) Davit Grigoryan filed a lawsuit against Liparit Melikjanyan, a member of the Supreme Judicial Council.
The reason for the lawsuit was Melikjanyan's interview given to Iravaban.net on August 13.
In the interview, Melikjanyan made the following statement. "Without getting to know the actual circumstances, the lawyers organize the collection of signatures, gather and defend Davit Grigoryan. Who are they protecting him from? Let's put the Davit Grigoryan factor aside. What does this mean? This individual, the judge, sets a court hearing without notifying the parties. Then on the day of that court hearing, he and his secretary are busy with family concerns, or I don't know, sitting in a cafe drinking a soft drink. Later, by forging the court hearing minutes, they sign it and insert it into the court files? And they consider this normal? In other words, official forgery by a judge on an official document can be interpreted as common in the judicial system, and is it normal? I approach signing decisions with great responsibility. I am aware of my responsibility, that if a judge makes an official forgery in an official document, and there are reasonable doubts about it in the Supreme Judicial Council, then the Supreme Judicial Council must definitely grant that petition.”
The plaintiff Davit Grigoryan demanded the member of the Central Committee deny defamatory information.
Update:
Davit Grigoryan presented a demand to Melikjanyan for 2 million drams and to require his denial of the defamatory information on the news website. On April 14, 2021, the court of first instance, presided over by Judge Karine Petrosyan, rejected the claim on the grounds that the information disseminated was not related to Davit Grigoryan.
On May 14, 2021, Grigoryan's representative filed an appeal. On March 11, 2022, the appellate court, presiding judge Naira Margaryan, judges Karen Chilingaryan and Margarita Hartenyan, decided to leave the decision of the first instance court unchanged. It entered into legal force.
The plaintiff, after exhausting the means of domestic protection, submitted a complaint to the European Court of Human Rights in order to protect his authority and reputation.
